What is a Visitor Record
A visitor record is a STATUS DOCUMENT that specifies the conditions and validity period of temporary stay in Canada and is issued:
· to visa-required or visa-exempt foreign nationals
· who are seeking to enter or are in Canada.
A visitor record is a document specify conditions applicable to the temporary resident during their stay. This allows
· you to stay in Canada longer as a visitor
· a worker authorized to work without a work permit in Canada or
· a student authorized to study without a study permit in Canada
· includes a new expiry date (the new date that you must leave Canada by)
Purpose of Visitor Record:
A visitor record may be issued to:
· extend or limit the length of stay of a temporary resident in Canada
· specify conditions applicable to the temporary resident during their stay
· a worker authorized to work without a work permit in Canada or
· a student authorized to study without a study permit in Canada
· change the temporary resident category from
o a study permit holder to a visitor
o a work permit holder to a visitor
Instances when Visitor Record Can be issued
AT POE
· visitor record can be issued to a temporary resident at the port of entry (POE) on their arrival to Canada when authorized length of stay other than the 6-month standard. (Could be less or more than 6 months)
· Foreign nationals who are eligible for the 120-day work permit exemption or the short-term (15- to 30-day) work permit exemption may request a visitor record at the POE. The issued visitor record would include remarks specifying the ability of the foreign national to work without a permit.
Inside Canada Applications:
· extend stay in Canada beyond their initial authorized stay
· restore their status as a temporary resident in Canada, following a loss of their status
· change the conditions of their stay
· A foreign national studying in Canada may be issued a visitor record to authorize a stay in Canada without a study permit to attend a course or program of study of 6 months or less.
Timelines for Submitting Visitor Record Applications
1. A temporary resident should apply at least 30 days in advance of their status expiring.
2. foreign nationals can apply for a Visitor Record within 90 days of losing their temporary resident status.
Other Relevant Points:
1. Visitor Record includes a new expiry date (the new date that you must leave Canada by)
2. If there is no stamp or handwritten date in the foreign national’s passport, their authorized period of stay is 6 months from the day they initially entered Canada, or until their passport expires, whichever comes first, as per subsection 183(2) of IRPR.
3. Applicant should meet all the required conditions of their respective status while applying for the Visitor Record.
a. Visitor needs to meet the requirements of a visit visa to get the stay extended.
b. Foreign nationals meet the eligibility requirements for the 120-day work permit exemption.
4. A visitor record doesn’t guarantee that you can leave and then re-enter Canada. If you plan to travel outside Canada or the United States, you need a valid entry document, such as a visitor visa or an ETA, to return to Canada.
5. Online application is better since application is submitted instantly and is processed faster.
6. Application Fee for Visitor record is $100. Please note that for some application where the status needs to be restored, Restoration fee is also Applicable.
