A Visitor Record is an official document issued by Immigration, Refugees and Citizenship Canada (IRCC) that grants individuals permission to extend their stay in Canada beyond their initially approved duration. Unlike a visa, it does not allow entry into Canada but serves to maintain legal status while remaining in the country. This article provides an overview of the process, eligibility requirements, and steps to apply for a Visitor Record.
About the process
A Visitor Record is necessary for visitors, workers, or students who wish to extend their stay in Canada beyond the period initially granted. Upon arrival, border officers either stamp the passport or provide an entry document with a specified expiry date. To remain in Canada beyond this date, individuals must apply for a Visitor Record before their current status expires.
Who Can Apply for a Visitor Record?
The following individuals may apply for a Visitor Record:
- extend their stay in Canada as
- a visitor
- a worker authorized to work without a work permit or
- a student authorized to study without a study permit
- change their temporary resident category from
- a study permit holder to a visitor
- a work permit holder to a visitor
How to Apply for a Visitor Record
Applying for a Visitor Record requires careful planning to ensure compliance with immigration rules. Follow these steps:
Step 1: Apply Before Your Status Expires
Applications must be submitted at least 30 days before the expiry date of your current status. If your status has already expired, you may need to apply for restoration of status, which has additional requirements.
Step 2: Gather Required Documents
Applicants must provide:
- A copy of their passport (including the page with the entry stamp).
- Proof of sufficient funds to support their stay.
- A detailed explanation of why they want to extend their stay.
- Any supporting documents, such as a return flight ticket or proof of ties to their home country.
Step 3: Submit the Application Online
The application for a Visitor Record must be submitted through the IRCC online portal. Applicants must create an account, fill out the necessary forms (IMM 5708), and upload required documents. The processing fee is typically $100 CAD.
Step 4: Wait for Processing and Decision
Processing times vary but can take several weeks. If approved, IRCC will issue a Visitor Record, which will be sent electronically or by mail.
If your status expires
If you apply to extend your stay in Canada before the date by which you’re supposed to leave, you can legally stay in Canada until a decision is made on your application. In this situation, you have maintained your status.
