If your status as a worker in Canada has recently expired, you may be eligible to restore it by submitting an application with the required documents. However, it's crucial to be aware of the strict timeline involved in this process.

 

90-Day Application Window

 

You must apply to restore your status within 90 days of losing it. If more than 90 days have passed since your status expired, you will not be eligible for restoration and will need to leave Canada and reapply for a work permit from outside the country.

 

**Required Documents**

 

To apply for restoration of your status within the 90-day window, you will need to gather the following essential documents:

 

1. **Application to Change Conditions or Extend Your Stay (IMM 5710)**: Complete this form, ensuring that you select "Restore my status as a worker" under section 3. Include a separate page providing a detailed explanation of why you remained in Canada beyond your authorized stay.

 

2. **Employer-Specific Documents**: Your employer must provide you with a copy of your Labour Market Impact Assessment (LMIA) and job offer letter for an employer-specific work permit, or an Offer of Employment number and job offer copy for an LMIA-exempt work permit.

 

3. **Personal Identification and Status Documents**: Include clear scans of your valid passport's identification pages and current or previous work permits, study permits, or visitor records.

 

4. **Proof of Payment**: You will need to pay the restoration fee ($239.75), work permit processing fee ($155), open work permit holder fee ($100, if applicable), and biometrics fee ($85, if required). Include proof of payment for all applicable fees with your application.

 

5. **Explanation Letter (if applicable)**: If you lost your status due to non-compliance with a permit condition, you must include a letter providing a clear explanation of the reasons for your non-compliance.

Gathering all necessary documents is essential for a complete and successful restoration application. Incomplete applications may be delayed, returned, or refused. By carefully compiling all required documents and submitting your application promptly within the 90-day window, you increase your chances of successfully restoring your status and maintaining your legal right to work in Canada.
