Have you previously had a refusal and not declared it in your application. If so, failing to declare previous immigration refusals in your application can lead to serious consequences. Honesty and full disclosure are as mandatory as any other information provided in immigration processes. Let’s list on all the negative consequences if you do not declare previous refusals:

1. Misrepresentation
  • Failure to disclose a previous refusal is considered misrepresentation- Misrepresentation involves providing false or misleading information or omitting important details in your application. This can be unintentional or intentional, but immigration authorities do not care about your intentions on non-disclosure. If you are found misrepresenting, you could be-
    • Banned for 5-year from applying for any immigration program in Canada.
    • Your application could be denied immediately, even if you are otherwise fully qualified.
    • And your Permanent Resident status (if already obtained) could be revoked if misrepresentation is discovered after approval.

2. Loss of Credibility

·        Failing to declare past refusals closes all your chances to gain your credibility and trust with immigration officers. Immigration officers rely on applicants being truthful throughout the process. Once an applicant is found to have hidden important information, even future applications can be treated with suspicion.

  • Even if you apply for a different visa or program, past instances of misrepresentation can negatively impact your eligibility.

3. Application Denial

  • Immigration officers may reject your current application immediately once they discover the nondisclosure or misleading aspect in your previous files. Canada and many other countries share immigration data, and your past refusals in one country can be easily accessed by immigration officers.
  • Even if your previous refusal seems minor or irrelevant to the current application, not declaring it can result in outright refusal of the new application.

4. Legal Consequences

  • Depending on the seriousness of the omission and misrepresentation, there may be legal consequences beyond just application denial, including fines or legal action.

5. Loss of Immigration Fees

·        You risk losing a lot of money the in application processing along with legal fees if your application is denied for non-disclosure. You also won't receive a refund for the application money you paid. 

 6. Delayed Processing

·        Authorities may ask for more explanation if they find discrepancies or omissions in background checks, which could cause serious delays in the processing of your application which could take up to months and sometimes years.

 

7. Impact on Family Members' Applications

·        If you are applying with or including your family members in your application , your misrepresentation could damage their applications as well. When one family member fails to report prior rejections, the entire family may be refused visas or prohibited   from entry for several years.

These are some of the major consequences of not letting the immigration officers know about your previous refusals and the repercussions of misleading the officers if caught can be huge.

How to Avoid Misrepresentations or Address Refusals:

ü  Provide a detailed letter of explanation including all past refusals and reasons : Address the refusals in the current applications.

ü  Attach supporting documents as proofs that you are addressing the previous refusals.

ü  Explain your current eligibility and how you have worked on your profile to improve your chances of approval in the current application.

ü  Address your mistakes and failure to disclose any information.
