Some facts about Pre Approved LMIA

Under the Temporary Foreign Worker Program, employers can apply for a Labour Market Impact Assessment (LMIA) before a temporary foreign worker (TFW) has been identified. These LMIA’s are known as Pre-Approved LMIA’s

Below is some basic information to understand pre-approved LMIA’s.

1.      Pre -Approved LMIA  is an approval for hiring a foreign worker for the position.

2.      These are not person-specific.

3.      Have to apply for a person-specific LMIA once Candidate is selected. This means getting the Name added to the LMIA.

4.      As soon as the TFWs have been identified, the employer must complete and submit the form "Request to Add or Remove a name on an LMIA (EMP5661)" to the appropriate Service Canada processing centre.

5.      TFWs must apply for a work permit from Immigration, Refugees and Citizenship Canada (IRCC) before the expiry date of the positive LMIA. Their applications for a work permit must include a copy of the official positive LMIA letter, the annexes, and the employment contract.

6.      An unnamed LMIA application can currently be submitted for positions in the following streams:

a.      Seasonal Agricultural Worker Program (including in Quebec)

b.      Agricultural stream (not currently available for positions in Quebec)

c.      In-home caregiver positions (not currently available for positions in Quebec)

d.      Low-wage stream

e.      High-wage stream
