Situations That May Prevent You from Becoming a Canadian Citizen

You may be ineligible to apply for citizenship if you fall under any of the following prohibitions:

1. Criminal Sentences in Canada or Abroad

  • You are currently serving a prison sentence, on parole, or on probation in Canada.

  • You are serving a sentence outside Canada for a criminal offense.

2. Charges and Ongoing Legal Proceedings

  • You are charged with, on trial for, or involved in an appeal for an offense:

    • Under the Citizenship Act

    • An indictable offence in Canada

    • An offense outside Canada that’s equivalent to an indictable offense in Canada

3. Immigration Issues

  • You are under a removal order, meaning you have been ordered to leave Canada by immigration officials.

4. Serious Criminal Offences

  • You are being investigated, charged, on trial for, or have been convicted of:

    • A war crime or crime against humanity.

  • You had a citizenship application refused for misrepresentation in the past five years.

  • You had Canadian citizenship revoked due to fraud in the past ten years.

5. Recent Criminal Convictions (Last 4 Years Before Applying)

  • If your application was received after June 11, 2015, and you were convicted of:

    • An indictable offence in Canada or an offence under the Citizenship Act within four years before applying.

    • A criminal offence outside Canada that is equivalent to an indictable offence in Canada, even if you received a pardon or amnesty.

6. National Security and Armed Conflict

  • While a permanent resident, you:

    • Were convicted of terrorism, high treason, treason, or spying offences.

    • Served as a member of an armed force or organized group engaged in conflict with Canada.
