On Sep 26, 2024, New measures for low-wage positions were introduced. These changes were majorly introduced to reduce the unemployment levels in the Canada. These changes aim to address labor market needs and ensure that Canadian employers focus more on hiring local workers.

 

I would Highlight the Main changes in this article so you can easily understand the Changes and its Impact.

These changes Impacted the LMIA Processing of Low wage LMIA Positions.

Low-wage LMIA Positions s are the Positions where the wage being offered to the Temporary Foreign Workers are offered wage that is below the provincial or territorial-wide median wage.

 

Certain LMIA applications submitted for low-wage positions will be affected by the following measures:

  1.  certain LMIA applications for low-wage positions in census metropolitan areas with an unemployment rate of 6% or higher won't be processed
  2.  in some sectors, the current 20% cap on the proportion of low-wage positions is being reduced to 10%
  3. in the construction and healthcare sectors, the cap on the proportion of low-wage positions is being reduced to 20%
  4. the maximum employment duration for low-wage positions is being reduced from 2 years to 1 year
  5. LMIA application won’t be processed if you're above the 10% or 20% cap on the proportion of low-wage TFWs at the same work location

 

Other Important Changes:

  1.  The maximum employment duration for low-wage positions is being reduced from 2 years to 1 year
  2. Refusal to process LMIA for any position if you have had an LMIA revoked in the past 2 years
