Inland and Outland spousal sponsorship are two different pathways under Family Class for sponsoring a spouse or common-law partner for permanent residency in Canada. The sponsor must be a Canadian Citizen or Permanent Resident, and must be 18 years or older to be able to sponsor a spouse or common-law partner.
We will discuss about the key differences between inland and outland sponsorship applications :
1. Inland Spousal Sponsorship
Who it’s for: Applicants who are already in Canada on a valid temporary status (e.g., visitor, worker, or student).
Can the applicant stay in Canada? Yes, they can remain in Canada while the application is processed.
Can the applicant work? They may be eligible for an open work permit while waiting for a decision.
Processing time: The processing time for inland sponsorship application is 28 months (if couple will be residing outside Quebec)
Appeal rights: If the application is refused, there is no right to appeal, but can submit a judicial review
2. Outland Spousal Sponsorship
Who it’s for: Applicants living outside Canada, or those in Canada who prefer processing through their home country’s visa office.
Can the applicant stay in Canada? They can visit Canada while waiting, but must maintain legal visitor status.
Can the applicant work? No automatic work permit, unless they obtain a separate work visa.
Processing time: The processing time for outland sponsorship application is 10 months (if couple will be residing outside Quebec).
Appeal rights: If refused, the sponsor has the right to appeal to the Immigration Appeal Division.
Which one to choose? The choice of proceeding with an inland sponsorship application or outland, depends upon individual circumstances. While both of the applications involve comprehensive documentation and proving the genuineness of relationship, inland applications can be more complex and have longer processing times.
