If your temporary resident status (such as study, visitor, or worker) expires, and you were unable to extend your status before it expires, then you automatically lose your status to continue your stay in Canada. In such situations, you can restore your status to the initial permit.
You must restore your status within 90 days from the day your initial permit has expired. After your initial permit expires, when you apply for a new study or work permit, you must also indicate that you want to restore your status in the same application.
During the time you restore your permit and apply for a new permit, you cannot resume work or studies. You must wait until a decision is made before resuming work, as you do not have an implied status during the restoration period.
Supporting documents will have to be submitted when you restore and apply for a new permit and the fees for restoration of status is $239.75 CAD as of May 2025. In addition, the fees for the new permit has to be paid at the time of submission to IRCC.
- You must meet the requirements for the specific type of permit you're applying for and have abided by the conditions of your previous permit.
- Please note that while your application for restoration is in process, there's no guarantee that it will be approved.
- To seek for restoration of your temporary status, you must stay in Canada.
- When you return, you will be considered to have applied for a new entry if you left the country.
Example:
Let’s say:
- Your Work permit expired: April 30
- Applicant applies for restoration + new WP: May 10
- Until the new work permit is approved (could be weeks/months), they cannot legally work in Canada.
However, for a work permit due to extended processing times as of May 2025, if you want to get your application processed faster, you can apply for an Outside Canada application while residing in Canada as a visitor. However, when the approval comes in, you will have to exit the country to obtain the new work permit.
NOTE: The Implied Status only applies if:
- The applicant applies for extension of their valid work permit before it expires.
- In that case, they can continue working under the same conditions while waiting for a decision (this is called implied status).
