Home Support Worker & Home Child Care Provider

This is a 5-year pilot program for those caregivers who want to obtain permanent residency along with their family members. This is the best program regarding family unification because the applicant can submit the work permit and PR application simultaneously. There are two categories in it. Category A- If an applicant has less than 12 months of experience, they can apply under Gaining experience category and Category B- if they have more than 12 months of experience, they can apply Direct to permanence category.

 

Requirements:

The following are the requirements of these programs:

·       Canadian 1-year post-secondary (or higher) educational credential or Educational Credential Assessment (ECA) verified foreign credentials equivalent to the Canadian standards.

·       Language proficiency of Canadian Language Benchmark (CLB) level 5 in English or French though a designated language testing organization. The test results must be less than 2 years old at the time of receipt.

·       A genuine job-offer from a Canadian employer.

·       Intent and ability to perform the duties according to the requirement of the NOC.

 

Job-Offer:

A valid job-offer must be:

·       from a single private individual and cannot be business, an embassy, high commission, or consulate in Canada. They can include more than one individual but constitute 1 single employer. The employer must obtain a CRA business number.

·       for a position outside the province of Quebec.

·       for full-time employment (at least 30 hours of paid work per week)

·       non-seasonal

·       in a home childcare provides or home support worker occupation

A job offer can be from a relative and the employee/employer relationship will be scrutinized at the same level.

 

Ability and Intent:

Those applicants who are applying under category A-less than 12 months of experience, must demonstrate that they are able to perform the job duties described in the lead statement of the NOC. They must submit proof of their work experience i.e. employer reference letters, employment records, work contracts, pay stubs, copies of their educational credentials and a copy of their most recent work permit. There is an exemption for certain candidates who have already finished obtaining their work experience in between the processing of their initial application and occupation-restricted work permit.

 

Permanent residency:

The application for permanent residency is assessed based on the education, official language proficiency and work experience. The qualifying work experience for both the categories was reduced from 24 months to 12 months on April 30, 2023. The category B applicants are assessed upfront, and the category A applicants are assessed after the issuance of their OROWP (occupation restricted open work permit). The applicants must submit proof of at least 12 months of their work experience in Canada within last 36 months in one of these jobs:

NOC 44100- Home child care provider (HCCP)

·       You must care for children in your own home or in your employer’s private home not in any institutional setting such as daycare.

·       You don’t need to live in your employer’s home to qualify.

·       Experience as a foster parent does not count.

NOC 44101- Home support worker (HSWP)

·       You must care for someone in your employer’s private home not in an institutional setting such as nursing home.

·       You don’t need to live in your employer’s home to qualify.

Although HCCP and HSWP are LMIA exempt but the applicants can work in Canada as temporary foreign workers (TFWs) under which they need an LMIA but the work might be identical. The employers need to pay for LMIAs and cannot receive this amount from the applicant. The LMIA fee exemption is for those employers who hire caregivers to provide care for the individuals requiring assistance with medical needs or to provide care to a child under 13 years of age where family’s gross annual income is $150,000 or less.
