No, the Ontario Immigrant Nominee Program (OINP) does not guarantee permanent residency (PR) in Canada, but it significantly increases your chances of obtaining it. Here's how it works:
- Ontario Nomination: Should your OINP application be accepted, Ontario will nominate you on a provincial level.
- Applying for PR through the IRCC nearly ensures an Invitation to Apply (ITA) for PR in the upcoming Express Entry draw since you receive 600 more CRS points if you applied under an OINP Express Entry stream.
- After obtaining your nomination, you must apply for permanent residence (PR) using the Permanent Residence Portal if you applied under a non-Express Entry stream.
- IRCC's PR Processing: Immigration, Refugees and Citizenship Canada (IRCC) makes the ultimate determination about permanent residence. Before awarding PR, they consider things like admissibility, background checks, and medical examinations.
IRCC Has the Final Authority
Even if Ontario nominates you, IRCC still needs to process and approve your PR application. They check:
- Medical exams (to ensure you are not a health risk)
- Police clearance (to confirm no criminal record)
- Admissibility to Canada (security concerns, misrepresentation, etc.)
- Financial stability (proof of settlement funds if required)
If you fail any of these checks, IRCC can refuse your PR application despite having an OINP nomination.
