To answer this question, first you need to understand exactly what types of work permits are there?
Canada majorly has 3 types of work permits.
- · LMIA required Closed work permit- As the name suggests, for this work permit, the employer must obtain a positive or neutral LMIA which then allows them to hire a foreign national who can apply for work permit with this LMIA. CHANGE OF EMPLOYERS - NOT ALLOWED!
- · LMIA EXEMPT Closed work permit- For this work permit, there is no requirement for any LMIA, and work permit can be applied with along with the accepted job offer. CHANGE OF EMPLOYERS- NOT ALLOWED!
- · OPEN WORK PERMIT- As the name suggests, no LMIA is required for this work permit. However, you need to understand that under this category, there are 2 subcategories-
1. Restricted- Your Open work permit can have restriction of location or/and occupation. CHANGE OF EMPLOYERS- ALLOWED WITHIN THOSE RESTRICTIONS!
2. Unrestricted- Under this, you get no restrictions and can work in any occupation, location anywhere across Canada. CHANGE IN EMPLOYERS- ALLOWED!
Please Note-
You may be eligible for an open work permit for vulnerable workers in situation as if you are experiencing or could experience abuse at employment in Canada.
This work permit will assist you in finding a new job where you can apply for new work permit with new employer and escaping an abusive situation, protecting your rights as a worker in Canada. However, it's only a temporary remedy, and it
1. Has a deadline and
2. Cannot be extended.
